We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

(k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

SECTION 13 - WARRANTY; LIMITATION OF LIABILITY

1. This Warranty is effective for ANAC solar water heater systems manufactured and installed after 1 January 2018.

2. If the customer has not paid in full for the ANAC solar water heating system then this warranty does not apply.

3. Warranty against defective factory parts from the date of purchase.

4. This Warranty does not apply to any defects or damage NOT due to faulty factory parts or workmanship including, but not limited to, defects or damage caused by or resulting from:

(a) accidental damage, storm damage, vandalism, failure due to misuse or abuse, or neglect of any kind;

(b) incorrect or improper installation of the ANAC Solar Water Heating System, including but not limited to, installation otherwise than in accordance with the instructions contained in the owner’s manual supplied by ANAC or incorrect system selection;

(d) power surges;

(e) animals, birds and/or rodents;

(f) the solar collector being left dry (no liquid circulation) and exposed to daily sunlight (i.e. not covered) for a period exceeding 14 consecutive days;

(g) excessive water pressure, negative pressure (partial vacuum), excessive temperature, corrosive atmosphere, faulty plumbing and/or electrical wiring;

(h) sludge/sediment as a result of connection to a water supply from filtered or treated sources ie. spring, dam, bore, river or town supply from a bore;

(i) contamination and corrosion from particles in the water supply;

(j) serial tags/stickers on any of the components being removed or defaced;

(k) the water stored in the cylinder exceeding at any time the followinglevels: Total hardness 200 mg/litre or p.p.mTotal dissolved solids 600 mg/litre or p.p.mElectrical conductivity 850 μS/cmChloride 250 mg/litre or p.p.mMagnesium 10 mg/litre or p.p.mSodium 150 mg/litre or p.p.mpH Min 6.5 to Max 8.5.

5. According to the national standard, the duration of this warranty is 5 years.

SECTION 14 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless ANAC Solar and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 - TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 18 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Cape Town, WC, 7140, South Africa.

SECTION 19 - PAYMENT OPTIONS AND TERMS

Anacsolar.com accepts the following payment methods:

Electronic Funds Transfer
Cash Deposits – 2% bank levy applies
No COD or Cheque payment options

It is your responsibility to determine whether the goods ordered are suitable for the purpose of intended use. Should you be uncertain as to the suitability of a product, please contact us for assistance prior to placing your order.

No order will be binding on anacsolar.com until it has been accepted by its management.

Payment for product/s ordered is due prior to shipment.

You may attend to payment via EFT, or via any of the approved methods of payments referred to above.

Where applicable, prices are quoted on the ruling day exchange rate and may increase as a result of adverse changes in the exchange rate. Until such time as we have received payment in full, we reserve the right to charge any fluctuations to the client’s account and the client undertakes to pay for such fluctuations on demand. It is the responsibility of the client to check that there have been no changes in the price prior to attending to payment.

SECTION 20 - REFUND AND RETURN POLICY

Anacsolar.com will not accept the return of any product without prior authorization and a confirmation return number issued anacsolar.com.

Customers agree to use only reputable carriers capable of providing proof of delivery and insurance for the entire value of the shipment. You are required to bear the cost of shipping and insurance required for the return of the goods to anacsolar.com. Anacsolar.com will not refund shipping charges, unless an error in delivery was made by anacsolar.com or the product is in fact found to be defective during the warranty period.

Customers agree that all returned products for credit, replacement or refund will be 100% complete, in a resalable condition, and will include the original packaging material, manuals, blank warranty cards, and other accessories provided by the manufacturer.

There shall be a 20% return charge (as per supplier/manufacturer charge) for returns due to the order being the fault of the consumer.

If any component of the returned product is missing, anacsolar.com will refuse to accept the return or may impose additional charges against you for the replacement of the missing component.

Anacsolar.com may impose a reasonable fee should it be necessary to restore the goods in order to render it suitably fit for re-stocking.

SECTION 21 - SHIPPING

Your total cost for purchase of any product will include shipping and handling charges as reflected on the anacsolar.com invoice.

You undertake to effect payment as specified on the invoice furnished to you and acknowledge that anacsolar.com may levy interest at the rate of 1.5% per month, on outstanding amounts, or the highest rate allowed by law, whichever is greater.

SECTION 22 - DELIVERY

Any delivery note or waybill (copy or original) signed by you or person accepting delivery on your behalf and held by anacsolar.com shall be sufficient proof that delivery was made to you. Goods delivered must be checked in order to confirm that the goods delivered are in accordance with the order placed and are free from visible damage/defect. Any discrepancies and/or visible defects must be noted on the delivery note/waybill.

Anacsolar.com reserves the right to split the delivery of goods ordered in the quantities and on the dates it decides with your prior consent, which consent shall not be unreasonably withheld.

Delivery of goods may arrive separately as they could be dispatched from different suppliers directly to your door for convenience.

Should you choose to engage a third party to transport the goods, you indemnify anacsolar.com against any claims of whatsoever nature that may arise from such an agreement.

Anacsolar.com warrants that it will endeavor to meet delivery times, but shall not be liable for any loss or damage of whatsoever nature which you may suffer as a result of any delayed delivery, unless the aforesaid has regard to circumstances within its reasonable control.
